1. Eligibility
You must be at least 18 years old to use this Site or make purchases. By using this Site, you represent that you are legally capable of entering into binding contracts and that all information you provide is accurate.
2. Products & Food Disclaimer
YoloFillCo sells food products. Products may contain or come into contact with allergens including dairy, nuts, soy, wheat, eggs, and other common allergens. You are solely responsible for reviewing ingredient lists and allergen disclosures. YoloFillCo is not responsible for allergic reactions or dietary sensitivities.
3. California Proposition 65 Notice
Certain products may contain substances known to the State of California to cause cancer, birth defects, or other reproductive harm. Where required, appropriate warnings will be provided.
4. Orders & Payment
All orders are subject to acceptance and availability. We reserve the right to refuse or cancel orders, limit quantities, correct pricing errors, or cancel suspected fraudulent transactions. Payments are processed securely via third-party providers.
5. Shipping & Risk of Loss
Risk of loss transfers to you upon delivery to the shipping carrier. We are not responsible for carrier delays, lost or stolen packages after delivery confirmation, or incorrect addresses provided by customers.
6. Perishable Goods Policy
Due to the nature of food products, all sales are generally final. We do not accept returns of perishable goods. Refunds or replacements may be issued at our sole discretion for damaged or defective products if reported within 48 hours of delivery with photo evidence.
7. Subscriptions (If Applicable)
If you enroll in a subscription, you authorize recurring charges. You may cancel prior to the next billing cycle. Failure to cancel before renewal may result in non-refundable charges.
8. User Accounts
You are responsible for maintaining confidentiality of account credentials and all activities under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
9. Intellectual Property
All content on the Site, including logos, text, graphics, images, and software, is the property of YoloFillCo or its licensors. Unauthorized reproduction or distribution is prohibited.
10. Prohibited Conduct
You agree not to use the Site for unlawful purposes, attempt unauthorized access, interfere with security, submit fraudulent orders, or initiate unjustified chargebacks.
11. Chargebacks & Fraud
We reserve the right to dispute chargebacks, suspend accounts, and pursue recovery of funds and associated costs if fraudulent activity is suspected.
12. Limitation of Liability
To the maximum extent permitted by law, YoloFillCo shall not be liable for indirect, incidental, consequential, or punitive damages. Our total liability shall not exceed the amount paid for the product at issue.
13. Disclaimer of Warranties
All products and services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied.
14. Indemnification
You agree to indemnify and hold harmless YoloFillCo from claims arising from your violation of these Terms or misuse of products.
15. Force Majeure
We are not liable for delays or failures caused by events beyond our control including natural disasters, supply chain disruptions, pandemics, or government actions.
16. Arbitration & Class Action Waiver
Any dispute shall be resolved by binding arbitration in California under AAA rules. You waive the right to a jury trial and to participate in class actions.
17. Governing Law
These Terms are governed by the laws of the State of California.
18. Termination
We reserve the right to terminate or suspend access for violations of these Terms.
19. Privacy
Your use of the Site is governed by our Privacy Policy.
20. Changes to Terms
We may modify these Terms at any time. Continued use of the Site constitutes acceptance of updates.
